The Ministry of Lands, Regional Government, and Religious Affairs has published an official statement in response to the ongoing squabble at the Brikama Area Council (BAC). In essence, the Ministry completely supports the suspended Chief Executive Officer and Director of Finance, while arguing that the change of signatories to the Brikama Area Council’s accounts is clearly in violation of applicable legislative provisions.
The Ministry’s statement indicates that the Local Government Service Commission received from the Brikama Area Council a recommendation for the removal of the Chief Executive Officer and Director of Finance due to alleged corruption and abuse of office. The Ministry’s statement explains that while the Commission is reviewing these allegations, the Brikama Area Council delegated their powers to subordinate staff, a move inconsistent with the provisions of the Finance and Audit Act, 2004, according to the ministry of Lands, Regional Government, and Religious Affairs.
“As the parent ministry of all area councils and municipalities throughout The Gambia, we maintain that until the Local Government Service Commission reviews the complaints and council’s resolutions and subsequently makes a determination about the duo, both individuals should continue to hold their respective positions. Equally, they should maintain their status as authorized signatories to the Council’s accounts, in accordance with the provisions of the Finance and Audit Act, 2004,” the government statement explains.
The statement continues to defend that BAC cannot act as a judge, jury, or advocate in this matter, as it would be a denial of justice. The Lands Ministry, as an oversight authority, communicated its concerns to the Brikama Area Council and other stakeholders in its November 30″, 2023, missive.
The Ministry says that it is disappointed with the Vice Chairman’s behavior and councilors after they tampered with the CEO’s vehicle, took keys from drivers, and caused disruptions. As a result, law enforcement intervened to restore order. According to the line Ministry, the Brikama Area Council has no authority to remove the CEO or Director of Finance, and partisan attempts to link the situation to other motives are a political maneuver.
