Gambiaj.com – (BUNDUNG, The Gambia) – Golden Beach Hotel, represented by Sheriff Marong, has filed a lawsuit against Senegalese business tycoon Abdoulaye Thiam and his company, Immo Gambia Hotels and Resorts Limited, seeking to recover $43,200 in unpaid rent. The case, which is being heard by Justice Jallow at the Bundung High Court, also includes claims for damages due to breach of covenants.
According to the court documents, Golden Beach Hotel is demanding the payment of the outstanding rent as well as compensation for the breach of the tenancy agreement. Additionally, the hotel seeks to regain possession of the property, known as Golden Beach Hotel and Resort, located in Bijilo, Kombo North District, West Coast Region. The hotel is also asking for profits and legal costs to be awarded in their favor.
The dispute stems from an agreement signed on February 9, 2023, between Golden Beach Hotel and Abdoulaye Thiam. The agreement stipulated a one-year lease starting from February 15, 2023, at an annual rent of $172,800, payable in monthly installments of $14,400. However, both parties later renegotiated the commencement date of the tenancy to June 1, 2023.
Golden Beach Hotel claims that Thiam paid the rent for the months of June, July, August, and September 2023 but subsequently defaulted. The hotel is invoking clause 6(a) of the tenancy agreement, which requires monthly rent payments, and clause 13, which allows for re-entry if rent is not paid within twenty-one days of the due date.
The case is currently before the Bundung High Court, and further details will be provided as the trial progresses.
