Police Murder Trial – Defense Claims Ousainou Bojang Gave Coercive Testimony.

Ousainou Bojang suspect

As the trial of Ousainou Bojang and his sister resumes, Lamin J. Darboe, the defense lawyer, stated that Ousainou was drugged and physically abused by law enforcement personnel from the anti-crime unit. According to the attorney, these violations took place prior to Ousainou providing a statement in which he is accused of killing two police officers and injuring another.

State witness detective Ebou Sowe continued his evidence in the anti-crime unit case, presenting voluntary statements from the accused on September 15, 2023. He claimed that every count was recorded in front of a separate witness, who translated the statements for the accused and reminded him of his right not to incriminate himself. The statements were delivered to the prosecution, and he would identify them by their writing, signature, and name.

Lamin J. Darboe, the defense attorney, opposed the prosecution’s request to submit documents as exhibits, arguing that the accused, Ousainou Bojang, had been compelled to make statements and that the statements were not freely obtained. They also cited physical abuse and the absence of an independent witness during the statement-taking process. The defense also argued that the documents did not meet the standards of the Evidence Act.

The defense attorney also objected to the tendering of documents, citing their incompleteness and lack of an independent witness’s signature. He urged the court to reject the requested tender documents, while the counsel, J. Darboe, argued that the documents did not meet the standards of the Evidence Act due to the absence of an independent witness.

The court has postponed the commencement of the voir dire (mini-trial) until tomorrow, January 30, at 14:15, to determine the admissibility of certain evidence in a legal case.
