Gambiaj.com – (Dakar, Senegal) – Lawyers representing Samuel Sarr, the former Managing Director of West African Energy (WAE), have submitted a new request for a bail, citing serious health concerns outlined in a recent medical report. The request, lodged on May 23, comes just days after the court-appointed medical expert concluded that Sarr’s deteriorating health is incompatible with continued detention.
Sarr, who was placed under a detention warrant on November 28, 2024, is under investigation for alleged abuse of corporate assets following a complaint filed by his partners, including Moustapha Ndiaye.
His legal team—composed of attorneys like Baboucar Cissé, Cheikh Amadou Ndiaye, and Amadou Dionewar Soumaré—has consistently raised alarms over his health condition since his incarceration.
Their concerns prompted a judicial order on April 9, 2025, for a medical evaluation. The assessment was conducted by Professor Maimouna Ndour Mbaye, an endocrinologist-diabetologist at the Abass NDAO National Hospital Center.
Her findings confirmed that Sarr suffers from multiple medical conditions that are likely to worsen in a prison setting, thereby rendering his detention medically inappropriate.
In their renewed application to the investigating judge of the 2nd chamber of the Dakar Tribunal de Grande Instance, Sarr’s attorneys cited Article 138-7 of the Criminal Procedure Code.
They proposed that he be released under house arrest with electronic monitoring, emphasizing that he poses no flight risk and offers full guarantees of representation.
“The medical report cannot be ignored. Samuel Sarr presents all the guarantees of representation,” the defense argued, urging the court to lift the detention order in light of the expert’s conclusions.
The court’s decision on the matter is awaited.
