Senegal: National Assembly Leaves Door Open For Fresh Bid To Prosecute Macky Sall After Initial Rejection

Gambiaj.com – (DAKAR, Senegal) – The Bureau of Senegal’s National Assembly on Monday rejected a resolution filed by Pastef parliamentarian Guy Marius Sagna seeking the prosecution of former President Macky Sall before the High Court of Justice, citing procedural irregularities, but crucially, without ruling on the substance of the request.

According to parliamentary sources, the Bureau’s decision was based on a vice de forme (procedural flaw) relating to Article 103 of the new organic law No. 2025-11 of August 18, 2025, which governs the Assembly’s internal regulations.

The article stipulates that only a parliamentary committee, a recognized parliamentary group, or a number of non-affiliated deputies equal to one-tenth of the Assembly’s members can table a resolution for debate.

Sagna’s initiative, submitted individually, therefore failed to meet these procedural requirements. As a result, it was rejected alongside several other resolutions presented in similar fashion.

However, the Bureau did not consider the merits of the proposed prosecution against Macky Sall, leaving open the possibility of resubmitting the request in compliance with the new legal framework.

Parliamentary observers see this as a key opening that could allow proponents of accountability for the former regime to return with a revised and properly endorsed motion.

The resolution was part of a broader push by members of the ruling Pastef coalition to seek legal proceedings against figures from Macky Sall’s administration.

The High Court of Justice, Senegal’s constitutional body for trying presidents, former presidents, and certain ministers, is empowered to handle cases involving high treason or other crimes committed in office.

Reacting to the rejection, Guy Marius Sagna said he “takes note” of the Bureau’s decision but described it as “debatable.

Writing on his social media pages, the outspoken lawmaker argued that the Bureau relied on provisions from the new internal regulations even though his texts were submitted under the previous version.

Sagna nonetheless pledged to revise and reintroduce his resolutions “in the coming days,” signaling his determination to pursue what he calls a matter of national accountability.

Political analysts suggest that while the rejection represents a temporary setback, it underscores the growing momentum within certain Pastef circles to demand judicial scrutiny of Macky Sall’s presidency, a campaign that may soon return to the Assembly floor under legally sound procedures.
