Gambiaj.com – (Kanifing, The Gambia) – Abdoulie Bah and Salif Camara have been remanded at the Mile 2 Central Prison for allegedly killing Abubacarr Ceesay at Alibaba Garden in SeneGambia. The case has been transferred to the High Court in Banjul as the Kanifing Magistrates’ Court lacks jurisdiction.
Presiding Magistrate Isatou Sallah Mbai transferred the matter after the duo were charged with murder contrary to section 183 of the Criminal Code Cap 10:01 Volume 3 Laws of The Gambia.
The prosecution, led by Chief Prosecutor Inna Jallow, alleged that on May 12, 2024, at Alibaba Garden and various places in the Kanifing municipality, the accused, with malice aforethought, caused the death of Abubacarr Ceesay by hitting his forehead on a concrete floor.
The charge sheet was read and interpreted to the accused in Wollof. Chief Prosecutor Jallow, representing the Inspector General of Police, emphasized that the charged offense attracts life imprisonment and urged the court to transfer the case to the High Court in Banjul.
She cited section 62 of the Criminal Code and section 208(A) of the Criminal Procedure Code, arguing that the Magistrates’ Court lacked the jurisdiction to continue with the matter and that the accused should be remanded at the Mile 2 Central Prison pending their appearance at the High Court.
In her ruling, Magistrate Sallah Mbai granted the prosecution’s application, transferring the case to the High Court in Banjul and ordering the remand of the accused at the Mile 2 Central Prison.
