Vybz Kartel Released After 13 Years – Court Cites Health and Juror Misconduct

The Court of Appeal denied a retrial, citing reasons such as juror misconduct and the artist’s deteriorating health. Fans and supporters of Kartel are ecstatic about his release.

Under the direction of Justice Marva McDonald-Bishop, the Court of Appeal issued a unanimous decision freeing Vybz Kartel and his co-defendants, Andre St John, Kahira Jones, and Shawn “Shawn Storm” Campbell. Kartel’s deteriorating health and the unavailability of trial exhibits and witnesses both influenced the decision.

The court pointed out the prosecution’s inadequate accounting for the availability of its witnesses and the fact that many trial exhibits were either nonexistent or could not be explained. Additionally, the substantial resources already used in the first trial were considered a heavy burden on the legal system.

Juror Misbehavior

The verdicts were reversed in March 2024 by the Privy Council, Jamaica’s highest court, due to juror misconduct. It was determined that Livingston Cain, a compromised juror who was later found guilty of accepting a bribe to influence other jurors, could not have been dismissed by the trial judge. This misbehavior significantly influenced the Court of Appeal’s decision against a retrial.

There has been widespread celebration following Vybz Kartel’s release. Supporters gathered outside the Tower Street Adult Correctional Centre in downtown Kingston, chanting “Free World Boss” as they awaited his release. The police and military roped off the area to maintain security and control the large crowd.

Legal Views

King’s Counsel Tom Tavares-Finson, who served as Kartel’s principal attorney, praised the decision, stating it served justice. He emphasized that the defense team’s numerous challenges during the trial gained legitimacy because of the Privy Council’s earlier judgment to overturn Kartel’s conviction.
