In the ongoing civil case between Senegalese businessman Abdoulaye Thiam and Gambian businesswoman Aisha Fatty, Mr. Bocar Dia, a Senegalese goods transporter, testified as the Fifth Plaintiff Witness (PW5). He stated that he delivered two bags of gold ornaments to Aisha Fatty, the 1st defendant, from Mr. Abdoulaye Thiam, the plaintiff.
Mr. Dia recounted that Abdoulaye Thiam had assigned him twice to transport gold ornaments and jewelry to Gambia, specifically instructing him to deliver the items to Aisha Fatty. He explained that upon his arrival in Gambia on both occasions, he contacted Aisha Fatty to arrange a meeting at her residence. However, she suggested meeting at the hotel where he was staying, the YMCA Guest House in Kanifing.
During the meetings, Aisha Fatty arrived with a male companion who was driving the vehicle. Mr. Dia stated that on his first visit, he brought two bags of gold jewelry, while the second visit involved a smaller quantity.
During cross-examination, Mr. Dia admitted that he was not aware of the exact quantity of gold ornaments he handed over to Aisha Fatty and affirmed that his role was limited to the handover.
The cross-examination also touched on whether Mr. Dia cleared the gold items with Gambian Customs Officers upon entry into the country. However, objections were raised regarding the potentially self-incriminatory nature of the question.
The presiding Judge, Justice Ebrima Jaiteh, stated that he would review the legal provisions and deliver a ruling on the objection during the next scheduled court date on 28th February 2024.
The case continues to unfold as both parties present their evidence and arguments before the court.
