Yankuba Touray appeared on Friday before the 5-member panel of Judges of the Supreme Court to overturn the decision of the Court of Appeal which upheld the decision of the High Court Judgment delivered by Justice Ebrima Jaiteh.
Touray, who was found guilty and sentenced to death by hanging for the murder of former Finance Minister Ousman Koro Ceesay, argued that the Lower Court failed to properly evaluate the evidence adduced by the prosecution before arriving at its decision. He seeks the Supreme Court to overturn the decision of the Court of Appeal and free him.
During the appeal process, Counsel for the appellant, A. Sissoho, urged the Court to set aside the High Court’s judgment against his client, discharge, and acquit him. On the other hand, Counsel for the Respondent (The State), Senior State Counsel M.B. Sowe, argued that the High Court’s judgment was based on sound legal principles and supported by evidence, urging the Court to dismiss the application filed by Yankuba Touray.
The Court of Appeal later upheld the High Court decision of Justice Ebrima Jaiteh.
Friday’s hearing at the Supreme Court marks another step in Yankuba Touray’s legal battle as he appeals against the decision of the Appeal Court. The case was mentioned and adjourned, with further proceedings expected in the near future.
