Gambiaj.com – (KANIFING, The Gambia) – The Kanifing Magistrate Court has ordered Ferreh Lulu Properties and its director, Lamin Ceesay, to refund D800,000 to a land buyer following a failed land transaction.
Magistrate Binta Sowe ruled that the plaintiff, Marabi Camara, had established his case on the balance of probabilities, noting that the evidence presented in court had not been challenged by the defendants.
The court heard that Camara paid D800,000 after being introduced to Ferreh Lulu Properties through a Facebook advertisement for land. However, despite repeated follow-ups, he said the land was not provided and he did not receive the relevant documentation.
The defendants later issued Camara a cheque for D750,000 as a refund, but the cheque could not be cashed. Camara subsequently pursued recovery of the full D800,000 he had paid.
In her judgment, Magistrate Sowe entered judgment in favor of Camara and ordered the defendants to refund D800,000. The court also awarded D4,000 in litigation costs and D20,000 in costs.
The ruling brings the dispute over the failed land transaction to a close, with the defendants now legally required to repay the full amount paid by the buyer.
