Gambiaj.com – (WASHINGTON, United States) – Former FBI director James Comey surrendered to authorities on Wednesday ahead of his initial court appearance in the Eastern District of Virginia, facing charges linked to an alleged threat against Donald Trump.
Comey, who briefly appeared before a federal judge in Alexandria, was released without any conditions following a hearing that lasted less than 10 minutes.
Presiding Judge William Fitzpatrick said restrictions were unnecessary, noting that similar conditions were not imposed during an earlier attempt by the Justice Department to prosecute the case last year.
The latest indictment, filed Tuesday, accuses Comey of making a threat against the president and transmitting a threat in interstate commerce. The charges stem from a social media post in May in which Comey shared an image of seashells arranged to form the numbers “86 47,” captioned: “Cool shell formation on my beach walk.”
The post quickly drew backlash from Republican figures and members of the administration, who interpreted the numbers as coded language implying harm toward Trump. In American slang, “86” can mean to eliminate or discard something, while Trump is the 47th president.
Legal experts, however, have expressed skepticism about the case. Eugene Volokh, a senior fellow at Stanford University’s Hoover Institution, argued that the post does not constitute a prosecutable threat.
Comey did not enter a plea during Wednesday’s hearing and did not speak as he entered and exited the courtroom through a side entrance typically used by defendants.
His legal team signaled plans to challenge the case, indicating they will file motions alleging selective and vindictive prosecution by the Justice Department.
The prosecution is part of a renewed push under acting Attorney General Todd Blanche, who has accelerated efforts to pursue cases that Trump has publicly supported, including those involving political adversaries.
Although the charges were filed in the Eastern District of North Carolina, Comey’s initial appearance took place in Virginia due to its proximity to his residence. The case will proceed in North Carolina under the oversight of U.S. Attorney Ellis Boyle.
No date has yet been set for Comey’s arraignment in North Carolina.
This marks the second attempt by the Justice Department to prosecute Comey. A prior case filed in September last year, accusing him of misleading Congress over media leaks, was dismissed after a judge ruled that the acting U.S. attorney handling the matter had been improperly appointed without Senate confirmation.
